Privacy Policy

This Privacy Policy explains Fabula’s policies and practices regarding the collection, use, and disclosure of information we receive and collect through or from Fabula’s applications, websites, user accounts, and any other services or products of Fabula, or any part thereof (collectively, the “Services”).

1.     Definitions

1.1.       For purposes of this Privacy Policy, "Personal Information" means any information that may be used to identify an individual, including, but not limited to, a first and last name, pen name, personal profile, a home or other physical address, credit card details, an e-mail address or other contact information, or other information that can be used to identify an individual.

2.     Consent to collection of Personal Information

2.1.       By voluntarily providing us with your Personal Information (such as in the framework of the registration process, or by sending us a comment, a request or a question), you are giving your consent to the collection, use, and distribution of your Personal Information by us, under the terms and for the purposes specified in this Privacy Policy and subject to applicable law.

3.     Uses of Personal Information

3.1.       We process your Personal Information only for specific and limited purposes. We ask only for data that is adequate, relevant and not excessive for those purposes. Some of these purposes may include:

3.1.1.     to enable you to use the Services;

3.1.2.     to contact you and to respond to questions and comments you may send us;

3.1.3.     to save you from re-entering the information when you access the Services;

3.1.4.     to provide you with marketing or promotional materials and other information that may be of interest to you (as further detailed below);

3.2.       In addition, we may combine your Personal Information and aggregate it with information collected from other users of the Services, in order to better design the Services by analyzing and evaluating the way the Services are being used. 3.3.       Subject to applicable law, we may transfer your Personal Information within the group of companies to which Fabula belongs or to Fabula’s third-party service providers, across borders, and from your country or jurisdiction to other countries or jurisdictions within the European Economic Area ("EEA") and outside of the EEA provided that the destination country ensures an adequate level of protection. We shall use reasonable efforts to limit the use of such information and to ensure that appropriate confidentiality and security measures are in place.

3.4.       Subject to applicable law, and if explicitly agreed to by you as part of the sign-up process or otherwise, we may share certain Personal Information, including, without limitation, your email address (but never your credit card information), with unaffiliated third parties that would enable them to contact you about products or services you may be interested in.

3.5.       Subject to applicable law, we may share and provide Personal Information and non-personally-identifiable information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf. We shall require that these persons agree to process such information in compliance with this Privacy Policy (as amended from time to time, in Fabula’s sole discretion), and we shall use reasonable efforts to limit their use of such information and ensure that they use appropriate confidentiality and security measures.

3.6.       We may also employ third party service providers to perform services related to the Services (such as hosting and maintenance services, payment clearance services, etc.). Such third parties will have limited access to your Personal Information to the extent necessary to perform their tasks, and are obligated not to disclose or use it for any other purpose. We may also use your contact information to send you updates, newsletters, or news regarding our services or those of our partners whose offers may interest you.

4.     Aggregated Information

4.1.       When you access or use the Services, information about your access or use (such as how you navigate the Services) may be collected and stored. This information may include your internet protocol ("IP") address, [your location], browser and platform type, the length of your visit, the date and time of your visit, the pages you viewed and the order of those pages, the amount of time spent on particular pages, and the websites you visit before and after visiting the Services website. It does not include any personally identifiable information such as your name, e-mail address, or telephone number. We use this information mainly to monitor and analyze the aggregate use of the Services, and for the Services’ technical administration. As mentioned above, we may aggregate such data (alone or with Personal Information) in order to better design the Services.

4.2.       Subject to the provisions of any applicable law, we may disclose and share such aggregated information (from which your Personal Information cannot be isolated) with interested third-parties. We may also provide advertisers with aggregate information and/or non-identifying information about the Services and its users.

5.     Cookies and other tracking technologies

5.1.       Some of our Services use "cookies" and other tracking technologies to collect information and to tailor the Services to the needs and interests of our customers. 5.4.       You should be aware that the Services use the services of third party suppliers for the provision of some of its services. To provide such services, these suppliers may also use cookies, for the reasons outlined above.

6.     Compliance with laws and law enforcement

6.1.       We may disclose any and all information, including Personal Information, if we are required to do so by any applicable law or regulation, or an order of a court or other governmental body having jurisdiction.

6.2.       We may also disclose your Personal Information if we, in our good-faith discretion, believe that such disclosure is necessary to: (i) enforce the Terms of Use; (ii) take precautions against possible liability; (iii) investigate and defend ourselves against any (yours or any third party’s) claims or allegations; (iv) protect our property and rights (including the security or integrity of the Services); (v) protect the property, rights or safety of any third party; and/or (vi) prevent or stop any illegal or unethical activity.

7.     Access and accuracy

7.1.       To the extent that you do provide us with Personal Information, you will have access to this Personal Information and you will be able to add information, and delete or correct this Personal Information.

7.2.       You may also, by written request, ask for a copy of the Personal Information that we keep about you (for the provision of such a copy we may, at our sole discretion, charge a small fee) or the rectification of such Personal Information.

8.1.       Our Services may use the services of third parties to present or manage advertisements that you may see in the framework of the Services. These third party ad servers may use cookies, web beacons, clear gifs or similar technologies to help present such advertisements, and to help measure and research the advertisements’ effectiveness. 10.  Event of merger, sale, or bankruptcy

10.1.    In the event that Fabula is acquired by or merged with a third party entity, we reserve the right, subject to applicable law, to transfer the Personal Information we have collected from our users as part of such merger, acquisition, sale, or other change of control.

10.2.    In the event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, your Personal Information may, subject to applicable law, be treated, transferred, or used by third parties.

11.  Data security

11.1.    We employ commercially reasonable physical, administrative, and electronic security measures and precautions to protect your Personal Information from unauthorized access or use and to ensure the integrity and security of your Personal Information.

11.2.    If your Personal Information is accessed by an unauthorized third party, we will not be responsible for any direct or indirect damage caused as a result of such unauthorized access. Although we will do our best to protect your Personal information, we cannot guarantee the security of any data transmitted to or through the Services. You acknowledge and agree that any transmission will be at your own risk.

11.3.    We recommend that you keep your login and password private and secure. For the avoidance of doubt it is clarified (and you hereby agree) that we cannot and will not be liable for any loss or damage that arises as a result of any failure to protect your password or account information.

12.1.    We reserve the right, at our sole discretion, to change, modify, or add to this Privacy Policy at any time without notice. Such amendments, updates and modifications shall be effective immediately upon their posting on the relevant Services website. Your continued use of our Services following the posting of changes to this Privacy Policy means you accept these changes. We recommend that you check the Services website periodically for any such amendments to this Privacy Policy. We further recommend that you print a copy of this Privacy Policy for future reference.

13.1.    By using the Services, you consent to the terms of this Privacy Policy, as they are from time to time, and to Fabula’s processing of your Personal Information for the purposes and using the methods stated above.
