2. Consent to collection of Personal Information
3. Uses of Personal Information
3.1. We process your Personal Information only for specific and limited purposes. We ask only for data that is adequate, relevant and not excessive for those purposes. Some of these purposes may include:
3.1.1. to enable you to use the Services;
3.1.2. to contact you and to respond to questions and comments you may send us;
3.1.3. to save you from re-entering the information when you access the Services;
3.1.4. to provide you with marketing or promotional materials and other information that may be of interest to you (as further detailed below);
3.1.5. to detect and protect against error, fraud, or other criminal activity;
3.1.6. to enforce our End User License Agreement, including but not limited to, carrying out security reviews to validate your identity, age, contact details and, if applicable, your financial information; and
3.1.7. in any other way as described to you at the time of collection of your Personal Information.
3.2. In addition, we may combine your Personal Information and aggregate it with information collected from other users of the Services, in order to better design the Services by analyzing and evaluating the way the Services are being used. We may disclose such aggregated information as provided below.
3.3. Subject to applicable law, we may transfer your Personal Information within the group of companies to which Fabula belongs or to Fabula’s third-party service providers, across borders, and from your country or jurisdiction to other countries or jurisdictions within the European Economic Area ("EEA") and outside of the EEA provided that the destination country ensures an adequate level of protection. We shall use reasonable efforts to limit the use of such information and to ensure that appropriate confidentiality and security measures are in place.
3.4. Subject to applicable law, and if explicitly agreed to by you as part of the sign-up process or otherwise, we may share certain Personal Information, including, without limitation, your email address (but never your credit card information), with unaffiliated third parties that would enable them to contact you about products or services you may be interested in.
3.6. We may also employ third party service providers to perform services related to the Services (such as hosting and maintenance services, payment clearance services, etc.). Such third parties will have limited access to your Personal Information to the extent necessary to perform their tasks, and are obligated not to disclose or use it for any other purpose. We may also use your contact information to send you updates, newsletters, or news regarding our services or those of our partners whose offers may interest you.
4. Aggregated Information
4.1. When you access or use the Services, information about your access or use (such as how you navigate the Services) may be collected and stored. This information may include your internet protocol ("IP") address, [your location], browser and platform type, the length of your visit, the date and time of your visit, the pages you viewed and the order of those pages, the amount of time spent on particular pages, and the websites you visit before and after visiting the Services website. It does not include any personally identifiable information such as your name, e-mail address, or telephone number. We use this information mainly to monitor and analyze the aggregate use of the Services, and for the Services’ technical administration. As mentioned above, we may aggregate such data (alone or with Personal Information) in order to better design the Services.
4.2. Subject to the provisions of any applicable law, we may disclose and share such aggregated information (from which your Personal Information cannot be isolated) with interested third-parties. We may also provide advertisers with aggregate information and/or non-identifying information about the Services and its users.
5. Cookies and other tracking technologies
5.1. Some of our Services use "cookies" and other tracking technologies to collect information and to tailor the Services to the needs and interests of our customers. A "cookie" is a small text file that is transferred from the Services' servers to your computer or device’s hard drive, and uniquely identifies you. Cookies can only be read by the server that sent them to you, and they cannot read data from your hard drive.

6.1. We may disclose any and all information, including Personal Information, if we are required to do so by any applicable law or regulation, or an order of a court or other governmental body having jurisdiction.

7.1. To the extent that you do provide us with Personal Information, you will have access to this Personal Information and you will be able to add information, and delete or correct this Personal Information.
7.2. You may also, by written request, ask for a copy of the Personal Information that we keep about you (for the provision of such a copy we may, at our sole discretion, charge a small fee) or the rectification of such Personal Information.

10. Event of merger, sale, or bankruptcy
10.1. In the event that Fabula is acquired by or merged with a third party entity, we reserve the right, subject to applicable law, to transfer the Personal Information we have collected from our users as part of such merger, acquisition, sale, or other change of control.
10.2. In the event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, your Personal Information may, subject to applicable law, be treated, transferred, or used by third parties.
11. Data security
11.1. We employ commercially reasonable physical, administrative, and electronic security measures and precautions to protect your Personal Information from unauthorized access or use and to ensure the integrity and security of your Personal Information.
11.2. If your Personal Information is accessed by an unauthorized third party, we will not be responsible for any direct or indirect damage caused as a result of such unauthorized access. Although we will do our best to protect your Personal information, we cannot guarantee the security of any data transmitted to or through the Services. You acknowledge and agree that any transmission will be at your own risk.
11.3. We recommend that you keep your login and password private and secure. For the avoidance of doubt it is clarified (and you hereby agree) that we cannot and will not be liable for any loss or damage that arises as a result of any failure to protect your password or account information.
